A trade name on a licence lets you operate; a registered trademark lets you stop others from trading on your reputation. In the UAE, trademarks are registered federally through the Ministry of Economy, and a registration, once granted, protects the mark across all seven emirates. This guide explains what can be registered, how the process runs and the decisions that determine whether an application succeeds.

What a trademark protects

A trademark is any sign that distinguishes your goods or services: a word, a logo, a combination of both, a slogan and, in some cases, a shape or sound. Protection is granted for specific classes of goods and services under the international Nice classification, so a mark registered for consultancy services does not automatically cover clothing or software. Choosing the right classes at the start is as important as the mark itself.

What cannot be registered

  • Marks that merely describe the goods or services, or are generic in the trade.
  • Marks that conflict with an earlier registered or well-known mark.
  • Signs that offend public order or morals, or that resemble official emblems, flags or religious symbols.
  • Geographical names that would mislead about origin.

Names of people, foreign-language words and stylised logos are commonly registrable, provided they are distinctive and not already taken.

The process, step by step

  1. Clearance search. A search of the UAE register (and, for exporters, the international registers) shows whether an identical or confusingly similar mark exists. Applying without a search is the most common way to lose the fee.
  2. Application. Filed electronically with the Ministry of Economy, one application per class, with a clear representation of the mark, the applicant's licence or passport details and a power of attorney where an agent files.
  3. Examination. The Ministry checks the mark for registrability and conflicts and may issue objections that must be answered within the set period.
  4. Publication. Accepted marks are published, opening a window in which third parties may oppose the registration.
  5. Registration. If no opposition is filed or the opposition fails, the registration certificate is issued on payment of the final fee.

An unopposed application typically completes in several months; oppositions or objections extend that.

Validity, renewal and international protection

A UAE trademark registration is valid for ten years from the filing date and renewable for further ten-year periods. Since the UAE joined the Madrid Protocol, businesses based in the UAE can extend protection to other member countries through a single international application, and foreign owners can designate the UAE in theirs. Registration is also what customs and the e-commerce platforms rely on when you ask them to act against counterfeits.

Practical guidance

  • Register the mark in the form you actually use; a logo that changes every year should be registered as a word mark as well.
  • File the Arabic version too if you trade under it, because the register treats transliterations as separate marks.
  • Cover the classes you will need within the next few years, not only today's.
  • Keep proof of use: invoices, packaging and advertisements are what defend a mark against a non-use challenge.
